General use of the Site
The information and services available on the site are provided for the sole purpose of individuals looking for employment opportunities and career information and for Employers and Recruiters (recruitment agencies) seeking to recruit staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial gain or purpose.
1.1
Users must not submit inaccurate information or submit information on behalf of somebody else.
1.2
Users must not breach or attempt to breach the security of the site in anyway.
1.3
The website is not to be used to destroy, transmit, distribute or store material that is in violation of any applicable law or regulation. Users are not to use the site in a manner that infringes copyright, trademark or intellectual property rights violating the privacy and personal rights of others.
1.4

925staff cannot guarantee that the site will operate error free at all times and that its software does not contain viruses or other harmful material. Each user whether client or candidate is responsible for protecting their PC/laptop against such virus, 925staff accepts no legal responsibility for the repair of any loss, destruction or damage to data or computer equipment which may occur while using material derived from the use of the website.
3.3
925staff is not liable for any action a user takes as a result of information advertisement posted on our site.
3.4

Termination of Services
5.1
925staff reserves the right to terminate services at any point without notice should any of the terms and conditions be breached.
5.2
In the circumstances where the client becomes insolvent, any notice shall be sent in writing to the registered office, any dispute arising from the contract terms shall be referred to an arbitrator nominated for the time being to be the president of the Law Society. Any person who is not a party to this agreement has no right to enter into the Contract (Rights of Third Parties) Act 1999 to enforce any term of agreement.
5.3
If any of the terms are held to be unreasonable then the rest of the terms and conditions still stand.
5.4
925staff will not be liable to any purchaser or be in breach of contract for any delay or failure to perform any of the obligations if the delay or failure is due to any cause beyond the company’s reasonable control. Without prejudice these includes Acts of God, explosions, flood etc. war or threat of war, import or export regulations, strike, lockouts or other industrial actions.
5.5
Where material is downloaded from the internet, an anti virus programme should be used and 925staff can accept no responsibility for any loss, destruction or damage to data or computer system which may occur while using material derived from the website.

Job Postings
1.1
All job advertisements on the 925staff website are posted by prospective employers and their agents and although 925staff will randomly monitor any job postings, we also have the right to decline such postings accordingly. 925staff except no responsibility or liability for the contents of job advertisements and expect prospective employers and their agents to carry out such verification procedures.
1.2
925staff require all clients who post jobs on to the site to adhere to the following rules regarding the format and content of the posting;
i) Clients must not duplicate job postings at the expense of other clients’ jobs.
ii) Clients must not use gratuitous keywords in job descriptions of job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.
iii) All job adverts posted on the website must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.
1.3
URLs or email links (live or text only) are not permitted in the body copy of the job description page.
1.4
Job postings must not contain any information that is seen to be racist, abusive, offensive, threatening, pornographic or obscene. Please note any unlawful purchases and prohibition on transmitting or communicating any material which infringes any other persons copyright trademarks, patents, more rights with Intellectual Property Rights of any nature, no solicitors or unauthorised materials are to be used or any other material under the Computer Misuse Act 1990.
1.5
Any posting which appears to discriminate on the grounds of Sex Discrimination Act 1975, Race Discrimination Act, Age Discrimination Act 2006 or Disability Discrimination Act 2005 are illegal and may be removed by 925staff at our discretion. If this is the case 925staff will not be liable to the client to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform the client accordingly.
1.6
925staff are able to respond to any complaints made by third parties in respect of any content of the advertisements and have a license to modify and edit any material publish or translate any material and irrevocable can waive all moral rights in respect of any material posted on the website.
1.7
All personal information must be used in accordance with the privacy policy and you warrant that all personal information is true correct and complete, you must notify 925staff immediately if there is any change in the personal information supplied.
2.
Processing Applications
2.1
As a client you agree to deal with any responses to an advertised job fairly and professionally and without bringing 925staff into disrepute.
2.2
You agree to indemnify 925staff from and against any claim brought by an individual against 925staff.co.uk arising from your breach of this obligation or any other of these terms and conditions.
2.3
925staff do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is the responsibility of the client to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.
3.
Employment Agencies and Employment Businesses
3.1
If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.
4.
CV Services
If the services you have purchased from 925staff include CV searches then you are
required to adhere to these clauses.
4.1
The CV search facility is subject to the candidate giving their permission for their personal details to be added to 925staff’s database to be viewed by clients. Should 925staff have reason to believe that the CV search is being abused by the client then we reserve the right to suspend or terminate the client’s contract with immediate effect and without any such funds being returned.
4.2
925staff does not guarantee the number of new CV’s available on the website on a daily basis; however we will continue to advertise accordingly.
4.3
All CV’s posted on the 925staff website are posted by candidates and although 925staff will randomly monitor any CVs we accept no responsibility or liability for the contents of CVs and have the right to decline accordingly.
4.4
925staff will be indemnifying itself from claims arising as per other Terms of Conditions for third party claims.
5.
Database Material
5.1
Information about any individual contained in the 925staff database must only be used in accordance with the clients own recruitment related requirements.
5.2
Clients are not permitted to;
i) Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.
ii) Download the database through any automated process.
iii) Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies.
5.3
Clients must comply with the Data Protection Act 1998 and all subsequent legislation and regulations at all times.
6.
Passwords and Login details
6.1
Passwords and any other login details are for the sole use of the person to whom they are issued by 925staff. The user is responsible of all activities under that password and should keep it confidential. If at any point you (the user) believe there is any unauthorised use, you should notify us (925staff) and 925staff will ask you to alter your username and password accordingly.
6.2
925staff reserve the right to deny a client access to their account should we have reason to believe that the username or password is being used by an unauthorised person or that the user is breaching these terms and conditions.
7.
Payment
7.1
To enable 925 to continue offering its service at a competitive rate we will require the completion of a service where applicable and all monies before the services can commence. Payment may be made using credit/debit cards on our online banking facility, in return 925staff will ensure jobs posted and CV search facilities remain live for a minimum period of 30 consecutive days.
7.2
If a payment on invoice is required, we cannot provide the service unless payment has been received in full and funds cleared. All invoicing carries a strictly 30 day payable period and late payments will incur interest at the rate of 3% above Barclays Bank base rate. Please note any transactions requiring invoicing will also carry an additional £25.00 per invoice surcharge.
7.3
The Client remains responsible for payment(s) for any unused service(s).
7.4
925staff can change the price(s) at any time.
7.5
All prices quoted are exclusive of VAT (17.5%).
8.
Intellectual Property Rights
8.1
925staff owns all intellectual property rights for any material, trademarks, software and logos contained in this site. 925staff also owns the design and layout of the website and the copyrights and rights registered in registered and unregistered trademarks are owned or licensed by 925staff.
8.2
925staff have the right to transfer any of these rights and obligations under the Terms and Conditions to any third party and will be notified by a website posting.
9.
Liability
9.1
925staff takes no responsibility for ensuring the suitability of the applicants who apply for a client’s vacancy. It is the responsibility of the client to verify the suitability of an applicant before engaging any such candidate.
9.2
It is also the responsibility of the client to obtain work or any other permits, to arrange medical examinations and/or investigations of any applicant.
9.3
925staff does not accept liability including liability for negligence, or any damages or losses resulting from the client’s use of (or inability to use) this site.
9.4
925staff does not accept liability for any loss or damage caused to the client, or a third party, resulting from any virus or other impairing computer program contained in any CV submitted by any applicant.
10.
Governing Law
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.

1.1

CV Posting
If a candidate has registered with 925staff and stored a CV then they must adhere to this clause.
2.1
The CV service is dependant on the instruction of the candidate that their CV should or should not be made available to Clients.
2.2
925staff will only make a candidates CV available to the client on the permission of the candidate to do so being received, by accepting these terms you are giving permission. 925staff will only make CV’s available for the purpose of securing employment for the candidate and for no other reason.
2.3
Candidates CV will be identified to the client by the search strings entered by the client.
2.4
Clients will have access to all searchable CVs in the 925staff database.
2.5
925staff makes no guarantee as to the number of clients that will view your CV.
2.6
925staff may at its own discretion refuse to display, distribute or forward any candidate information or CV or amend such information should they have reason to believe it is illegal, immoral, obscene or offensive.
2.7
All candidates storing and saving information on 925staff must ensure that;
i) All information and CV’s they store or save on the website is true and accurate and reflects a true picture of their education and employment history and that all personal information is correct.
ii) They are aware that should 925staff discover that any information submitted by the candidate is false or inaccurate in anyway that 925staff reserves the right to suspend or refuse the services of the site to that candidate.
iii) All information or CV’s submitted by a candidate must represent a true and living person. If any candidate submits information on behalf of a third party they must have obtained the permission of the said third party.
2.8
Candidates are able to hide their CV either at the time of registering a CV with 925staff or at any time thereafter.
3.
Registration Data
3.1
All candidates must ensure that any data, whether in the form of a CV or a registration form, must be true and accurate and reflect accurately your education and employment history.
3.2
925staff reserves the right to remove any candidate information that is found to be false or inaccurate in any way. 925staff also reserves the right to suspend the use of the site to a candidate whose details are found to infringe these terms and conditions.
3.3
